1. Acceptance of Terms

By accessing or using Split ("Split," "we," "us," or the "Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Split is a payment splitting application that allows users to split expenses, manage group payments, and facilitate automated payouts. The Service includes AI-powered calculations and payment processing features.

Split is not a bank, card network, credit bureau, escrow agent, trustee, money manager, or guarantor of any user's payment obligation. We provide software and payment coordination tools integrated with third-party processors; users remain responsible for the underlying expenses, payment requests, settlement decisions, and records they create.

The Service is intended for documented shared-expense reimbursement and settlement among known group members through payment flows supported by our payment partners. Split does not sell products, trips, tickets, lodging, transportation, services, or merchandise to guests or payors, and Split is not a marketplace, travel seller, ticket reseller, remittance service, or general-purpose peer-to-peer money transmission service. When a user pays through Split, they are reimbursing the host or group member who created the eligible shared expense or receives the payout.

3. User Responsibilities

  • You are responsible for maintaining the confidentiality of your account.
  • You agree to provide accurate and complete information, including payment, payout, tax, identity, and contact information.
  • You will not use the Service for any illegal, unauthorized, fraudulent, or deceptive purpose.
  • You are responsible for confirming that each expense, split, receipt, guest, amount, and payment request is accurate before you send or collect payment.
  • You will not attempt to gain unauthorized access to any part of the Service.

4. Payment Processing and Processor Terms

Split enables payment processing through third-party payment providers. You acknowledge that all payment transactions are subject to the terms and conditions of these third-party providers.

Payments, payouts, refunds, reversals, payment-method storage, identity checks, sanctions screening, and dispute handling may be provided by Stripe, PayPal, Venmo, banks, card networks, ACH operators, or other regulated payment partners. By using payment features, you agree to comply with applicable processor, bank, card-network, ACH, and payment-method rules, including the Stripe Services Agreement and, if applicable, Stripe Connected Account Agreement.

5. Hosts and Payment Recipients

If you create a group, upload a receipt, request payment, or receive a payout, you are responsible for the accuracy and legitimacy of the underlying expense and for communicating with your guests or payors. You must not request payment for false, inflated, duplicate, unauthorized, illegal, or misleading expenses.

You are responsible for guests you invite or charge understanding why they are being charged and for resolving questions before they escalate to a bank, card issuer, payment app, or payment processor. If a guest, payor, bank, card issuer, payment app, or payment processor disputes, reverses, returns, or claws back a payment connected to your group or payout, you remain responsible for that disputed amount and all related fees, penalties, assessments, costs, and losses, even if you already received a payout.

6. Guests and Payors

If you pay through Split, you agree that you are authorizing a payment for the expense shown to you. If you believe a charge is incorrect, duplicate, unauthorized, fraudulent, or otherwise invalid, you agree to contact Split support and the group host first when reasonably possible so the issue can be reviewed or refunded through the Service.

Filing a false, abusive, or bad-faith dispute or chargeback for a valid payment is prohibited. You may be responsible for losses, costs, fees, and account restrictions caused by an improper dispute, subject to applicable law and payment-network rules.

7. Disputes, Chargebacks, Returns, and Reversals

A "Dispute" includes any chargeback, payment dispute, ACH return, bank reversal, payment-app reversal, refund demand, fraud claim, unauthorized-payment claim, processor debit, network assessment, or similar reversal or claim involving a payment made through Split.

Payment processors and financial institutions may immediately debit disputed amounts and dispute fees. Dispute outcomes are decided by the applicable bank, payment method, processor, or network; Split cannot guarantee that any dispute will be won, even if you provide evidence.

You authorize Split to investigate, accept, challenge, submit evidence for, or decline to contest any Dispute in our discretion. You agree to provide complete and timely evidence we request, including receipts, itemized expense details, guest communications, delivery or attendance records, proof of authorization, refund history, and any other information needed to respond to a Dispute. You authorize us to share relevant account, transaction, receipt, device, communication, and payment information with processors, banks, card networks, payment apps, guests, hosts, and service providers as needed to prevent fraud, process payments, collect amounts owed, or respond to Disputes.

8. Payouts Are Provisional; Reversals and Recovery

Payouts, balance credits, and settlement confirmations are provisional until the related payment is no longer subject to refund, reversal, return, chargeback, processor hold, network adjustment, or other Dispute. Receiving a payout does not mean the underlying payment is final.

If a payment connected to your account, group, receipt, or payout is disputed, reversed, refunded, returned, or otherwise debited, you authorize Split, to the fullest extent permitted by law and processor rules, to recover the amount from you. Recovery may include reversing or reducing payouts, debiting your Split balance, creating a negative balance, withholding or delaying future payouts, offsetting amounts from future payments, charging or debiting any payment method or external account you provide, requesting immediate repayment, suspending payment features, or using collection remedies.

We may place reserves, rolling reserves, holds, payout delays, or transaction limits on your account when we believe there is elevated risk, including high dispute activity, unusual payment behavior, inaccurate information, suspected fraud, unresolved negative balances, or processor requirements.

9. Refunds and Corrections

Refunds and split corrections should be handled through Split whenever possible. If you are a host or payment recipient, you are responsible for refund amounts, corrected split amounts, processor fees, and any additional costs caused by inaccurate requests, duplicate charges, unauthorized charges, or guest disputes related to your group.

10. Taxes, Records, and Compliance

You are responsible for maintaining records, determining whether any taxes apply to payments or payouts you send or receive, and complying with laws that apply to your use of the Service. We may request identity, tax, business, or transaction information and may suspend payments or payouts if you do not provide requested information.

11. Prohibited Activity

You may not use Split for fraud, money laundering, cash advances, payment-card testing, sanctions evasion, illegal goods or services, deceptive payment requests, collusive disputes, stranger commerce, product or ticket resale, travel sales or travel reservation services, remittances, unrelated cash transfers, general-purpose peer-to-peer money transmission, money services activity, artificial transaction volume, or any activity prohibited by our payment partners. We may reject, reverse, delay, or report transactions that we believe violate these Terms, law, or processor rules.

12. Limitation of Liability

In no event shall Split, its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

13. Indemnification

You agree to defend, indemnify, and hold harmless Split, its affiliates, officers, directors, employees, agents, processors, and service providers from claims, losses, liabilities, damages, fees, penalties, costs, and expenses arising from your use of the Service, your payment requests, your payouts, your guests' or payors' Disputes, your violation of these Terms, your violation of law or processor rules, or your inaccurate, fraudulent, unauthorized, or misleading activity.

14. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation.

15. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.
